Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you (the "Merchant", "you") and Tiny Shops ("Tiny Shops", "we", "us"), the operator of the Tiny Shops platform for building and running shops on Telegram (the "Service"). By creating an account, connecting a Telegram bot, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract. You authenticate through Telegram; you are responsible for your Telegram account, your bot token, your dashboard credentials, and all activity under your account. Tell us promptly at legal@tiny-shops.com if you suspect unauthorized access.

2. The Service and your store

Tiny Shops provides software that lets you create and operate a storefront delivered through a Telegram bot you control. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own commercial purposes while these Terms are in effect. You are solely responsible for your store: the products and content you list, your prices, your fulfilment, your customer service, your tax obligations, and your store's compliance with all laws applicable to you and your customers.

3. Payments to you from your customers

Payments that your customers make for goods or services in your store are transactions between you and your customer, processed through the payment method you connect (for example Telegram Stars, Tribute, or another payment provider you configure). Tiny Shops is not a party to those transactions, does not take custody of those funds, and is not responsible for chargebacks, refunds, disputes, delivery, or the conduct of your customers or your chosen payment provider. You are responsible for offering and honouring a lawful refund and returns policy to your own customers.

4. Subscription fees and billing

Use of the Service requires a paid subscription after any free trial. New stores include a 7-day trial; if you do not cancel before it ends, the subscription you selected begins and recurring fees apply.

  • Subscription fees are billed in advance on the cycle you choose (monthly or annual) and recur until cancelled.
  • Billing is handled by our payment partner Polar, which acts as the merchant of record for your subscription and may collect applicable taxes.
  • Some plans include usage-based charges (for example, contacts above an included allowance). Usage charges are calculated per cycle and billed in arrears.
  • You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid period.
  • Except where required by applicable consumer law, fees already paid are non-refundable. We may change pricing on at least 30 days' notice, which takes effect at your next renewal.

5. Acceptable use

You agree not to use the Service, and not to let anyone use your store, to:

  • sell or promote goods or services that are illegal where you or your customers are located;
  • commit fraud, launder money, or facilitate sanctioned or prohibited transactions;
  • infringe intellectual property, privacy, or publicity rights;
  • distribute malware, spam, or deceptive or harmful content;
  • harass, threaten, or harm others, or violate any applicable law or platform rule, including Telegram's Terms of Service;
  • probe, overload, reverse-engineer, or circumvent the security or access controls of the Service.

We may investigate suspected violations and may suspend or remove content or access to protect the Service, our users, or third parties.

6. Your content and data

You retain ownership of the content and data you upload. You grant us a limited licence to host, process, and display that content solely to operate and improve the Service for you. You represent that you have the rights needed to provide it and that it does not violate these Terms or any law. How we handle personal data is described in our Privacy Policy.

7. Our intellectual property

The Service, including its software, design, and trademarks, is owned by Tiny Shops and protected by intellectual property laws. These Terms grant you no rights in the Service except the limited right to use it described above.

8. Third-party services

The Service relies on third parties (including Telegram, the payment providers you connect, Polar for subscription billing, and our hosting and infrastructure providers). Your use of those services is governed by their own terms, and we are not responsible for their acts, omissions, availability, or content.

9. Service availability and changes

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, in whole or in part, and will give reasonable notice of material adverse changes where practicable.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that your store will be profitable.

11. Limitation of liability

To the maximum extent permitted by law, Tiny Shops will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the amount of subscription fees you paid to us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnity

You agree to indemnify and hold Tiny Shops harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your store, your content, your transactions with your customers, or your breach of these Terms or any law.

13. Suspension and termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that creates risk or legal exposure for us or others. On termination your right to use the Service ends; sections that by their nature should survive (for example, fees owed, disclaimers, limitation of liability, and indemnity) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the country in which the operator of Tiny Shops is established, without regard to conflict-of-laws rules, and the courts located there will have jurisdiction over disputes, except where mandatory consumer-protection law in your country of residence gives you additional rights or a different forum.

15. Changes to these Terms

We may update these Terms. If we make material changes, we will update the "Last Updated" date and take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
